IMPORTANT INFORMATION
WAVE SKIPPERS operates as a booking and personnel-arrangement intermediary, connecting vessel owners, charter companies and private customers with independent freelance skippers and crew members.
WAVE SKIPPERS does not own, maintain, insure, navigate or operate Customers’ vessels.

We make reasonable efforts to verify the qualifications, experience and appropriate professional liability cover of the freelance personnel we arrange.
Marine services are performed by the identified independent Service Provider under the relevant service agreement. Responsibility for vessel operation, damage and other incidents shall be determined by the applicable agreement, insurance arrangements and law.
Nothing in these Terms excludes WAVE SKIPPERS’ own liability where it cannot lawfully be excluded.
By making a booking, the Customer confirms that they have read, understood and accepted these Terms & Conditions.
These Terms apply to bookings made through our website, email, telephone, WhatsApp or any other approved booking channel.

6.5 WAVE SKIPPERS does not guarantee that a qualification recognised in one jurisdiction is automatically recognised in another.
6.6 Qualifications and insurance may require additional verification for specific assignments.
6.7 The appointed Service Provider must comply with their applicable professional and legal responsibilities.
6.8 Document checks undertaken by WAVE SKIPPERS do not amount to a guarantee that all future legal or insurance requirements will remain satisfied.
7. Quotations and Pricing
7.1 Quotations apply only to the assignment described when issued.
7.2 Prices may vary according to the vessel, location, duration, required experience and nature of the assignment.

7.5 Additional Services or expenses require agreement wherever reasonably practicable before being incurred.
7.6 Obvious clerical or technical quotation errors may be corrected before booking acceptance.
7.7 Where a material error is identified after acceptance, the parties may agree a revised amount or an appropriate cancellation and refund, subject to applicable legal rights.
7.8 Any applicable taxes and compulsory charges shall be disclosed as required by law.
8. Accepted Currencies and Payments
8.1 WAVE SKIPPERS accepts payments in three currencies:
-
GBP – British Pounds Sterling (£).
-
EUR – Euros (€).
-
USD – United States Dollars ($).
8.2 Quotations and invoices may be issued in any accepted currency.
8.3 The amount and currency stated in the invoice or Booking Confirmation determine the agreed payment obligation.
8.4 Banks and payment providers may impose currency conversion fees and international transaction charges.
8.5 WAVE SKIPPERS is not responsible for independent charges or conversion rates imposed by the Customer’s bank.
8.6 Where WAVE SKIPPERS converts an amount between currencies, the applicable exchange rate shall be disclosed or agreed when invoicing.
8.7 Refunds shall ordinarily be processed in the original payment currency and method, where practicable and legally required.
8.8 Exchange-rate fluctuations may result in a different equivalent amount being received in another currency.
8.9 Any payment surcharge shall comply with applicable legislation.
9. Deposits, Balances and Payment Obligations
9.1 WAVE SKIPPERS may require a deposit or full advance payment.
9.2 The amount and payment deadline shall be disclosed before confirmation.
9.3 Unless otherwise agreed, outstanding balances must be settled before the assignment commences.
9.4 Failure to pay on time may result in cancellation after appropriate notice.
9.5 WAVE SKIPPERS may collect payments on behalf of the identified independent Service Provider where this is disclosed.
9.6 The Booking Confirmation shall distinguish intermediary fees and Service Provider charges where applicable.
9.7 The Customer is responsible for all authorised additional charges and lawfully payable expenses.
9.8 Payments received for an assignment shall be accounted for according to the identified contractual arrangements.
9.9 Any statutory refund obligations remain unaffected.
10. Changes to Bookings and Assignments
10.1 All assignments are accepted for specific dates, durations, vessels, routes, departure locations, destinations and agreed Services.
10.2 Any requested amendment, before or during the assignment, requires express approval by WAVE SKIPPERS and, where applicable, the independent Service Provider.
10.3 WAVE SKIPPERS may refuse amendments including:

-
Changes to departure or arrival locations.

-
Extensions of hire periods.
-
Additional sailing days.
-
Additional overnight passages.

Changes to the vessel.
-
Additional operational responsibilities.
10.4 WAVE SKIPPERS is not obliged to accept a requested amendment or disclose its internal commercial or scheduling reasons for refusal, except where disclosure is legally required.
10.5 Refusal may arise from other bookings, professional commitments, onward travel, personnel availability, qualifications, licensing limitations, insurance restrictions or operational requirements.
10.6 The Customer acknowledges that independent Service Providers may have other assignments before or after the agreed booking.
10.7 Offering additional payment does not require WAVE SKIPPERS or the Service Provider to accept a change.
10.8 A request that would exceed applicable qualifications, licensing permissions or legal operating limits shall be refused.
10.9 Approved changes may result in additional fees and expenses, which shall be agreed wherever reasonably practicable.
10.10 Unless an amendment is accepted, the original Booking Confirmation remains applicable.
10.11 A Customer’s decision not to proceed solely because a requested change has been declined shall be subject to the applicable cancellation provisions and statutory rights.
10.12 Nothing prevents a skipper from changing a route or destination where reasonably necessary for safety, emergencies or compliance with maritime law.
11. Customer Cancellations
11.1 Customers should cancel bookings in writing by emailing waveskippershire@gmail.com or using an agreed written booking channel.
11.2 The time of cancellation shall ordinarily be determined by receipt of the cancellation notice, except where statutory cancellation rules provide otherwise.
11.3 Unless different arrangements are expressly agreed, the following standard cancellation schedule applies:
More than 72 hours before the assignment: 80% refund, with 20% retained as a booking and cancellation charge.
Between 24 and 72 hours before the assignment: 50% refund.
Less than 24 hours before the assignment: No refund under the standard schedule.
11.4 These charges must remain fair and proportionate. Where a Customer is a consumer, any retained amount shall be limited to what is legally recoverable after considering actual costs, losses, reserved capacity and reasonable mitigation.
11.5 WAVE SKIPPERS shall not recover the same loss twice through cancellation charges and other payments.
11.6 Statutory cancellation rights and any required larger refunds take precedence over the standard schedule.
11.7 Where the assignment has commenced, charges may apply for Services performed, reasonable expenses and amounts lawfully recoverable.
11.8 Special assignments may have additional cancellation arrangements where disclosed and accepted before booking confirmation.
11.9 Cancelled flights, personal travel changes, missed connections or difficulties reaching the vessel do not automatically create a right to cancel without charge where the booked Services remain available.
11.10 Customers are advised to obtain appropriate travel and cancellation insurance.
12. Statutory Consumer Cancellation Rights
12.1 Customers who qualify as consumers retain all applicable rights under consumer protection legislation.
12.2 Certain distance or off-premises service contracts may carry a statutory cancellation period of 14 days.
12.3 Some services connected with leisure activities to be performed on a specified date or during a specified period may be exempt.
12.4 Whether an exemption applies shall be determined by the nature of the service and applicable law, not solely by the booking description.
12.5 Where a statutory cancellation right applies, WAVE SKIPPERS shall provide the information and cancellation arrangements required by law.
12.6 Where the Customer expressly requests performance during a statutory cancellation period, any lawful charges following cancellation shall be calculated under the applicable rules.
12.7 Where required, a standard cancellation form shall be made available.
12.8 Nothing in the standard cancellation schedule overrides a statutory right to cancel.
13. Cancellation or Refusal by WAVE SKIPPERS
13.1 WAVE SKIPPERS may refuse, suspend or cancel an assignment for legitimate reasons including:
-
Unsafe vessel condition.
-
Missing or inadequate insurance.
-
Missing legal documentation.
-
Unlawful proposed operation.
-
Licensing restrictions.
-
Personnel unavailability.
-
Materially inaccurate information.
-
Serious Customer misconduct.
-
Significant operational or safety concerns.
13.2 Where immediate safety or legal concerns exist, cancellation or suspension may occur without advance notice.
13.3 Where reasonably practicable, the Customer shall be informed of the relevant concerns.
13.4 Where cancellation results from the Customer’s material breach, reasonable cancellation charges, expenses and losses may be recoverable.
13.5 Where WAVE SKIPPERS cannot fulfil its own confirmed intermediary obligations for reasons within its responsibility, an appropriate refund or alternative arrangement shall be offered.
13.6 WAVE SKIPPERS may offer a suitable replacement Service Provider where available and agreed.
13.7 Nothing excludes remedies arising from WAVE SKIPPERS’ own breach of contract.
14. No Show and Failure to Provide Access
14.1 A No Show may occur where:
-
The Customer fails to attend the agreed location.
-
Access to the vessel is not provided.
-
The vessel is unavailable at the agreed time.
-
The required representative is absent.
-
The Customer cannot be contacted despite reasonable attempts.
14.2 Reasonable attempts shall be made to contact the Customer before the assignment is treated as a No Show.
14.3 Where personnel are present and available to commence Services, reasonable standby or cancellation charges may apply.
14.4 Charges shall take account of actual costs, reserved time and reasonable efforts to minimise losses.
14.5 A No Show does not automatically mean that all Marine Services have been performed.
15. Vessel Condition and Seaworthiness
15.1 The Customer and Owner are responsible for ensuring that the vessel is seaworthy, technically sound, appropriately maintained and suitable for the proposed assignment.
15.2 The Customer and Owner are responsible for the vessel’s:
-
Hull and structural condition.
-
Engines and propulsion.
-
Steering systems.
-
Rigging and sails.
-
Electrical systems.
-
Navigation equipment.
-
Radio and communication equipment.
-
Safety and lifesaving equipment.
-
Mechanical maintenance.
-
Known defects and restrictions.
15.3 The Customer must disclose all known material defects and outstanding repairs before the assignment.
15.4 The vessel must be reasonably prepared for the proposed voyage at the agreed commencement time.
15.5 The Owner remains responsible for pre-existing defects, ordinary maintenance and vessel preparation, subject to the legal duties of others.
15.6 WAVE SKIPPERS may refuse or cancel an assignment where, in its reasonable opinion, the vessel’s technical condition is inadequate, unsafe, doubtful or unsuitable.
15.7 WAVE SKIPPERS is not required to obtain a professional survey before exercising this right where reasonable safety concerns exist.
15.8 A skipper’s preliminary inspection does not constitute a professional marine survey or guarantee of seaworthiness.
15.9 Acceptance of a booking does not confirm the vessel’s technical suitability.
15.10 Nothing excludes legal duties owed by the appointed skipper or WAVE SKIPPERS.
16. Vessel Legality, Registration and Documentation
16.1 The Customer and Owner are responsible for ensuring that the vessel is lawfully registered, legally authorised and appropriately documented for the proposed assignment.
16.2 This includes compliance with relevant:
-
Flag-state requirements.
-
Registration and ownership laws.
-
Commercial coding and certification.
-
Customs and immigration requirements.
-
Navigation permissions.
-
Safety regulations.
-
National and international maritime laws.
-
Geographic and operational restrictions.
16.3 The Customer must disclose whether the vessel is intended for private or commercial operation.
16.4 The Customer must provide documents reasonably required to establish the legal basis for the proposed voyage.
16.5 WAVE SKIPPERS reserves the right to refuse or cancel an assignment where, in its reasonable opinion, the vessel’s legality, documentation or regulatory compliance is inadequate, doubtful or unacceptable.
16.6 No Customer may require WAVE SKIPPERS or a Service Provider to undertake an unlawful operation.
16.7 Where additional permits or authorisations are necessary, these must be obtained before the relevant assignment.
16.8 Responsibility for knowingly supplying false or misleading vessel documentation remains with the party responsible for providing it, subject to applicable law.
17. Vessel Insurance – Customer Obligations
17.1 The Customer and Owner are responsible for arranging and maintaining adequate and valid insurance covering the vessel and its intended operation.
17.2 Insurance must be appropriate for:
-
The vessel type and value.
-
Intended private or commercial use.
-
The proposed geographical area.
-
The planned voyage or delivery.
-
The appointed skipper and crew.
-
Hull and machinery risks.
-
Third-party liabilities.
-
Other risks relevant to the assignment.
17.3 The Customer must ensure that the appointed professional skipper and crew are permitted to operate the vessel under the insurance policy.
17.4 Where insurer approval is required, the Customer must obtain it before the assignment.
17.5 Where necessary, written confirmation of cover or a relevant policy endorsement must be obtained.
17.6 WAVE SKIPPERS may request copies of insurance schedules, certificates, endorsements and relevant policy conditions.
17.7 WAVE SKIPPERS may refuse, suspend or cancel a booking where, in its reasonable opinion, insurance cover is insufficient, invalid, uncertain or unsuitable.
17.8 The Customer acknowledges that a vessel insurance policy may impose geographical, commercial, operator or weather-related restrictions.
17.9 The Customer must disclose any material restrictions affecting the proposed assignment.
17.10 WAVE SKIPPERS does not guarantee that the Owner’s insurance will respond to every incident.
18. Professional Liability Cover
18.1 WAVE SKIPPERS makes reasonable efforts to arrange freelance skippers and crew with appropriate professional qualifications and liability protection.
18.2 The suitability of professional liability cover shall depend on the proposed assignment and applicable legal requirements.
18.3 Relevant cover may include professional skipper liability, third-party liability or other marine-related insurance appropriate to the Services.
18.4 WAVE SKIPPERS may request evidence of such cover from independent Service Providers.
18.5 A Service Provider’s professional liability policy does not automatically replace the Owner’s hull and machinery insurance.
18.6 Some incidents may fall under the Owner’s vessel insurance, the Service Provider’s liability insurance or another applicable policy.
18.7 Insurance remains subject to policy wording, exclusions, limits, geographical restrictions and claim conditions.
18.8 WAVE SKIPPERS does not guarantee that every loss or claim will be insured or paid.
18.9 WAVE SKIPPERS is not the insurer or financial guarantor of independent Service Providers.
19. Right to Refuse Unsafe or Unlawful Assignments
19.1 WAVE SKIPPERS reserves the right to refuse, suspend or cancel any skipper hire, crew hire, yacht delivery, boat delivery or vessel relocation assignment where reasonable concerns exist regarding vessel safety, technical condition, legality, insurance or documentation.
19.2 This right may be exercised before booking confirmation, before departure or during an assignment where relevant concerns subsequently arise.
19.3 WAVE SKIPPERS may act upon credible information supplied by the Owner, Service Provider, insurers, authorities or other relevant sources.
19.4 A definitive technical or legal determination is not required where reasonable grounds already justify refusal.
19.5 The appointed skipper retains independent authority to refuse or suspend an unsafe or unlawful operation.
19.6 Customers acknowledge that safety and legal compliance take priority over itinerary and commercial preferences.
19.7 Where the Customer’s material breach prevents the assignment proceeding, reasonable expenses and other lawfully recoverable charges may apply.
19.8 Where a refusal is unjustified and constitutes a breach by WAVE SKIPPERS, applicable Customer remedies remain available.
20. Owner Authorisation
20.1 The Customer must have the legal authority to arrange the proposed Services.
20.2 For yacht and boat deliveries, WAVE SKIPPERS may require written authorisation from the Owner.
20.3 Authorisation may identify:
-
Vessel name and registration.
-
Owner’s details.
-
Appointed skipper.
-
Departure and destination.
-
Proposed dates.
-
Authority to operate and relocate the vessel.
-
Relevant insurance arrangements.
20.4 The Owner must provide additional documentation where legally required.
20.5 WAVE SKIPPERS may decline an assignment where ownership or authorisation is unclear.
20.6 The Customer is responsible for losses caused by knowingly providing false authority or documentation, to the extent legally recoverable.
21. Vessel Inspection and Condition Records
21.1 The vessel may be subject to a preliminary condition and equipment check before commencement.
21.2 The skipper may document visible defects, equipment, fuel levels and relevant observations.
21.3 Photographs, video records and written notes may be used to record vessel condition.
21.4 The Owner must disclose known defects that may not be visible during preliminary inspection.
21.5 A preliminary check does not constitute a professional marine survey.
21.6 The Owner remains responsible for vessel maintenance and pre-existing defects, subject to applicable law.
21.7 Where material defects are identified, the skipper may require correction before departure.
21.8 The Customer acknowledges that a vessel may contain latent defects that are not discoverable through a routine preliminary check.
22. Skipper’s Authority and Operational Decisions
22.1 The appointed skipper or master retains the navigational authority and responsibilities required by applicable maritime law.
22.2 This includes decisions concerning:
-
Safe departure.
-
Route selection.
-
Passage planning.
-
Navigation and manoeuvring.
-
Weather conditions.
-
Safe vessel operation.
-
Entry into ports of refuge.
-
Emergency action.
-
Suspension of unsafe passages.
22.3 Customers and passengers must follow lawful and reasonable safety instructions.
22.4 The Customer may request itinerary changes but cannot require a skipper to undertake an unsafe or unlawful passage.
22.5 A skipper may change course or destination where reasonably necessary for safety or legal compliance.
22.6 Where practicable, the Customer shall be informed of material changes.
22.7 Such safety-related decisions do not constitute acceptance of a requested commercial extension or change of assignment.
23. Yacht and Boat Deliveries
23.1 Deliveries are arranged for the identified vessel, agreed departure point and agreed destination.
23.2 The Owner must ensure that the vessel is prepared, documented, appropriately insured and suitable for the intended delivery.
23.3 Delivery completion dates are estimates unless expressly guaranteed and remain subject to safe and lawful operation.
23.4 The Owner must provide sufficient operating funds, fuel, supplies and necessary equipment.
23.5 The skipper may suspend a delivery where the vessel becomes unsafe or unsuitable.
23.6 Necessary emergency steps may be taken to protect life, property or the environment.
23.7 The Customer remains responsible for agreed vessel operating expenses and reasonably necessary emergency expenses not arising from another party’s legally established fault.
23.8 Any additional Services beyond the agreed scope require acceptance and appropriate charging arrangements.
24. Delivery Route and Destination Changes
24.1 The agreed delivery destination is an essential part of the assignment.
24.2 Any request to change the destination, route, scheduled ports or delivery duration must be expressly accepted by WAVE SKIPPERS and, where applicable, the Service Provider.
24.3 WAVE SKIPPERS may refuse any such change without providing a detailed explanation of its internal reasons, except where legally required.
24.4 Refusal may arise from other professional commitments, onward travel, subsequent assignments, licensing limitations, insurance conditions or operational requirements.
24.5 An offer of additional payment does not create a right to demand an amendment.
24.6 Unless a change is accepted, the original agreed delivery arrangements remain applicable, subject to safety and legal requirements.
24.7 Any accepted change may result in a revised quotation and additional expenses.
25. Skipper and Crew Travel Expenses
25.1 The Customer is responsible for all reasonable and necessary travel expenses incurred by the skipper or crew in travelling to the vessel at the start of the assignment and returning from the agreed completion location, unless expressly included in the quotation.
25.2 These expenses may include:

Flights.
-
Airline baggage fees.

-
Other agreed travel expenses.
25.3 Travel arrangements may be organised by the Customer or WAVE SKIPPERS.
25.4 Where WAVE SKIPPERS arranges travel, advance payment may be required.
25.5 Travel expenses are separate from skipper and crew hire fees unless expressly included.
25.6 Customer-requested and accepted changes that increase travel costs may result in additional charges.
25.7 WAVE SKIPPERS shall make reasonable efforts to avoid unnecessary travel expenditure.
25.8 Expenses arising from WAVE SKIPPERS’ own breach of contract shall not automatically be transferred to the Customer.
26. Food and Daily Food Allowance
26.1 For skipper hire assignments, the Customer is responsible for providing suitable meals, food and drinking water for the skipper throughout the agreed hire period at the Customer’s expense.
26.2 Meals and provisions must be reasonably sufficient for the assignment.
26.3 Where the Customer does not wish to provide food and meals, a daily food allowance may be paid instead.
26.4 The standard food allowance is £50 (fifty pounds sterling) per skipper per day.
26.5 The allowance applies to each agreed calendar day of skipper hire for which suitable food and meals are not supplied, unless otherwise agreed in writing.
26.6 The allowance may be invoiced in GBP, EUR or USD using the agreed or quoted exchange rate.
26.7 The allowance is separate from hire fees, travel, accommodation and other expenses.
26.8 Where the Customer agrees to provide meals but fails to do so, reasonable necessary food expenses may be charged, up to the agreed allowance unless additional expenditure is authorised or reasonably necessary for safety.
26.9 Food and provision arrangements for additional crew members shall be stated in the Booking Confirmation where applicable.
26.10 Where the Customer pays the agreed food allowance, they are not additionally required to provide the skipper’s ordinary meals during the same covered period unless expressly agreed otherwise.
27. Accommodation and Crew Welfare
27.1 Where overnight accommodation is required, the Customer shall provide suitable on-board accommodation or pay for agreed alternative accommodation.
27.2 Accommodation must permit reasonable rest and appropriate welfare.
27.3 The Customer must provide reasonable access to drinking water, sanitation and necessary facilities.
27.4 Skippers and crew must be allowed adequate rest consistent with maritime safety and applicable law.
27.5 No Customer may require continued operation where fatigue makes an activity unsafe.
27.6 Any additional necessary accommodation costs must be agreed wherever reasonably practicable.
28. Vessel Operating Expenses
28.1 Unless expressly included, the Customer is responsible for the vessel’s reasonable operating expenses.
28.2 These may include:

28.4 Receipts or reasonable supporting records shall be supplied where available.
28.5 Emergency expenditure may be incurred where reasonably necessary to protect life, the vessel or the environment.
28.6 Expenses arising from negligence or breach of contract shall be allocated according to the legally responsible party.
29. Weather, Delays and Standby Time
29.1 Marine assignments are affected by weather, sea conditions, tides, visibility, port restrictions and other operational factors.
29.2 Departure and arrival times are estimates unless expressly guaranteed.
29.3 The skipper may delay departure or alter a passage where reasonably necessary for safety.
29.4 WAVE SKIPPERS does not guarantee that a particular itinerary can be completed within a specified period where safe operation is prevented.
29.5 Weather delays may result in additional marina, accommodation, travel, subsistence or standby costs.
29.6 Additional standby fees must be agreed or disclosed in advance wherever reasonably practicable, including the applicable rate or calculation method.
29.7 The Customer is responsible for agreed and lawfully payable additional costs arising from delays not caused by WAVE SKIPPERS’ breach.
29.8 Both parties shall make reasonable efforts to reduce avoidable expenses.
29.9 Customers should allow flexibility for onward travel and other personal arrangements.
30. Repairs, Maintenance and Emergency Decisions
30.1 The Owner remains responsible for routine maintenance, vessel servicing and pre-existing technical defects.
30.2 Where mechanical or technical defects occur during an assignment, the skipper may take reasonable action necessary to protect the vessel and persons aboard.
30.3 Non-emergency repairs should be approved by the Owner before expenditure is incurred.
30.4 Where immediate action is necessary to protect life, the vessel or the environment, reasonable emergency expenditure may be authorised without prior Customer approval where obtaining it is impracticable.
30.5 The Owner shall be responsible for necessary repairs and maintenance resulting from ordinary wear, latent defects or pre-existing vessel condition, except where legal responsibility falls upon another party.
30.6 Where repairs arise from negligence or breach of duty by a Service Provider, responsibility shall be determined under applicable law and insurance arrangements.
30.7 WAVE SKIPPERS does not guarantee repair costs or undertake to finance vessel maintenance.
31. Vessel Damage and Other Losses
31.1 WAVE SKIPPERS acts as a booking intermediary and does not itself navigate, maintain or operate Customers’ vessels.

31.5 WAVE SKIPPERS is not the vessel insurer or guarantor of the Service Provider’s financial obligations.
31.6 A Customer may pursue an appropriate claim against the legally responsible party.
31.7 WAVE SKIPPERS shall not be liable merely because it introduced or coordinated an independent Service Provider.
31.8 WAVE SKIPPERS remains responsible for its own actionable negligence, misrepresentation, breach of contract or failure to exercise reasonable care and skill in providing its intermediary services.
31.9 No clause in these Terms removes liability that cannot legally be excluded.
32. Insurance Claims and Vessel Repairs
32.1 In the event of an accident or vessel damage, the Owner shall ordinarily notify the vessel’s relevant insurer and submit a claim under the applicable hull, machinery or other marine insurance policy.

33.6 The Customer must cooperate with reasonable insurance and incident documentation requests.
33.7 WAVE SKIPPERS may retain relevant booking communications and documents for lawful insurance, legal and operational purposes.

34.2 Relevant reasons may include severe weather, serious mechanical failure, inadequate vessel condition, missing documentation or other significant operational concerns.
34.3 Where reasonably possible, the skipper shall arrange safe berthing or another appropriate protective measure.
34.4 The Owner shall be informed of the situation and available options as soon as reasonably practicable.

34.7 Where continuation requires a material change to the assignment, fresh agreement may be required.
